SwathMap Terms of Service
Effective Date: October 15, 2026
These terms are a contract between Agri Flight Logs LLC ("AFL", "we", "us"), which provides SwathMap, and the business that signs up for or uses SwathMap ("you"). By creating an account, clicking to accept, or using SwathMap, you agree to them for your business. If you accept on behalf of a company, you confirm that you can bind it. SwathMap is for business use, not personal or household use.
These terms include the Data Processing Addendum (the "DPA"), the Data-Use Statement and the End-User License Agreement (the "EULA"), and should be read with our Privacy Policy. Each is published at swathmap.com.
1. Definitions
- Service: SwathMap, which covers the SwathMap app and website (including swathmap.web.app and app.swathmap.com), the SwathMap API, the processing, storage and delivery of maps, and related support, under any brand described in section 2.2, but not the sites that section excludes.
- Customer Data: everything you or your users upload to or create in the Service, including photos and the metadata embedded in them; maps and other Outputs; boundaries, obstacles, no-spray areas, notes and drawings; the names you give maps and fields; exports; and your sessions with tools such as automatic field outlining.
- Outputs: the files the Service makes from your uploads, including orthomosaics, map tiles, elevation data, quality reports, boundaries and other vector layers, measurements, prescriptions and exports for drone controllers.
- Plan: the subscription and any add-ons you buy, as described on our pricing page or in the Service.
- Grower: a farmer, landowner, tenant or anyone else whose land you fly or map.
- Partner App: an app operated by another company through which you use SwathMap under that company's agreement.
2. The Service
2.1 What SwathMap does. SwathMap processes aerial imagery you upload into maps, lets you draw and manage boundaries, obstacles, no-spray areas and notes, and lets you export and share the results. We will provide the Service substantially as described in our current documentation and plan descriptions.
2.2 Brands. SwathMap may be offered under our own brand or under a dealer's or partner's brand (for example, "powered by SwathMap"), and through more than one domain. Whatever brand or domain you see, the Service is operated by AFL and these terms apply. A dealer or partner whose brand appears is not a party to these terms, is not our agent, and cannot change these terms or make commitments for us. This section doesn't cover sites on swathmap.com addresses that another business operates and identifies as its own.
2.3 Other apps. These terms apply when you sign up for SwathMap directly. If you use SwathMap inside the Agri Flight Logs or ApplicatorView apps, the Agri Flight Logs terms govern that use instead. If you use SwathMap through a Partner App, your agreement with that app's operator governs your account, and we process your data under our agreement with that operator.
2.4 Beta features. Features we mark as beta, preview or early access are provided as they are, may change or end at any time, and are excluded from any service commitments.
2.5 New features. We may add, change or remove features. These terms apply to every feature, including new ones. If a feature carries additional terms or fees, we will show them to you before you first use or buy it. We will not materially reduce the core features of your Plan during a term you have paid for.
2.6 Who may use SwathMap. You must be at least 18 and using SwathMap for a business. SwathMap is offered from the United States to businesses in the United States and Canada, except Quebec. You may not use SwathMap if you are, or act for, a person on a U.S. sanctions list, or from a country under a comprehensive U.S. embargo.
3. Accounts
3.1 Your responsibility. You are responsible for your account, for everything your users do in it, and for keeping logins and API keys secret. Use multi-factor sign-in where we offer it.
3.2 One person per login. Each person needs their own login. Don't share credentials. Where we offer team features, add each person as a separate user.
3.3 Tell us about problems. Tell us promptly if you suspect someone has unauthorized access to your account.
3.4 Your organization's data. If your account belongs to a company, the company controls the data in it, including data entered by users who later leave.
3.5 Account recovery. If you lose access, we will verify your identity before restoring it, for example with account details and the last four digits of the card on file. We will never ask you for a full card number or your password.
4. Plans, fees, renewals and refunds
4.1 Plans and add-ons. Your Plan sets your storage allowance, the number of maps you can have in progress at once, and your processing slots. You can add storage or processing lanes as add-ons where we offer them. Prices and what each Plan includes are on our pricing page or in the Service. Processing times vary with demand and dataset size and are not guaranteed (section 9).
4.2 Renewal and cancellation. You pay in advance for each monthly or annual term. Plans and add-ons renew automatically until you cancel. You can cancel at any time in your account; cancellation takes effect at the end of the term you have paid for.
4.3 Trials. If we offer a free trial, we will tell you at sign-up how long it lasts and whether it converts to a paid Plan automatically. If it converts automatically, we will charge you at the end of the trial unless you cancel before then.
4.4 No refunds. Fees are non-refundable, including when you cancel or downgrade during a term. When you cancel, your Plan runs to the end of the term you paid for. A map that fails, is incomplete or doesn't meet your expectations is not, by itself, grounds for a refund; you can upload again within your Plan's limits. You accept this policy when you accept these terms.
4.5 When we do refund. We refund prepaid fees only in these cases:
- (a) we stop offering the Service, or the Plan or add-on you paid for, before the end of your term;
- (b) you end this agreement because of our material breach that we don't fix within 15 days of your written notice (section 15.2);
- (c) we tell you about a material change to these terms (section 19.2) and you cancel before the date it takes effect. A material change is one that takes away a right you have under these terms, adds to what you must do or pay during your current term, or broadens how we may use your Customer Data. Price changes at renewal follow section 4.8 instead. To use this, cancel in your account or email support@agriflightlogs.com before the date in our notice, and say you are cancelling because of the change;
- (d) you object to a new subprocessor, we can't reasonably accommodate the objection, and you end the affected Service (DPA sections 7.3 and 7.4).
In each case your subscription, or the affected Service, ends early, and we refund the prepaid fees for the rest of your term, counted from the day it ends.
4.6 Upgrades and downgrades. When you upgrade, the change applies at once and we credit the unused value of your current Plan toward the new one. Downgrades, and switches between monthly and annual billing, apply at your next renewal.
4.7 Pause. If we offer a pause plan, you can switch to it before your Plan ends; while paused, your maps stay viewable and downloadable and processing is off, and its price is on the pricing page.
4.8 Price changes apply from your next renewal, with at least 30 days' notice.
4.9 Taxes. Prices exclude taxes. We collect sales or similar taxes where the law requires.
4.10 Failed payments. If a renewal payment fails and isn't fixed within our retry period, your subscription ends on the day the retries stop, and section 10.4 applies from that day.
4.11 Billing questions. If you think a charge is wrong, tell us within 30 days of it. We will review it and correct any error that is ours.
4.12 Closed-beta accounts. If you joined during the closed beta, we will give you at least 30 days' notice before we start charging you. If you leave instead, you can export your maps, drawings and exports free.
4.13 Dealers. If you buy SwathMap through a dealer or on a dealer's recommendation, you are our customer and these terms apply. The dealer is an independent business, not our agent.
5. Your data, and what we may do with it
5.1 You own your data.
- Between you and us, you own your Customer Data, including the Outputs.
- To the extent we have any rights in an Output, we assign them to you. One exception: our own pre-existing materials included in an Output, such as styles, templates, symbols and export formats. We keep those, and give you a perpetual, royalty-free license to use them as part of that Output.
- You may use, share and sell your Outputs, including by delivering them to your own customers.
- We own the Service itself: our software, models, processing methods and documentation.
- Between you and your growers, who owns field data is for you and them to agree. You confirm that you have the rights from your growers that you need to upload their field data and use it with the Service.
5.2 Our license. You give us a non-exclusive, worldwide, royalty-free license to host, copy, process, transmit, modify (for example, to convert formats or make map tiles) and display your Customer Data only to:
- (a) provide the Service to you, and to the people and apps you choose to send data to;
- (b) keep the Service secure, prevent abuse and investigate problems;
- (c) give you the support you ask for, or fix a problem our quality checks find;
- (d) improve the Service and train its models as section 5.3 allows;
- (e) compile de-identified statistics as section 5.4 allows;
- (f) comply with the law.
The license ends when the Customer Data is deleted under section 10, except for any copy the law requires us to keep, copies in backups until they are overwritten, and training copies under section 5.3. Section 5.3 also covers what remains in a trained model.
5.3 Improving the Service, and training our models.
- Performance data. We use the Service's own operating data to improve it: processing times, error codes, quality-check results and similar.
- What we may train on. Once the setting described below is available in your account, we may use your photos, maps, boundaries and other drawings, and outline-tool sessions to train and improve the models and processing that run SwathMap, such as field outlining, obstacle and weed detection, and map quality checks.
- What we remove first. Before we use them, we remove identifying details: your account details, the names you give maps and fields, and device serial numbers in photo metadata.
- On for new uploads unless you turn it off. This use is on for Customer Data you upload after the effective date of these terms unless you turn it off. Customer Data uploaded before that date is used only if you opt in.
- Training copies. Copies made for training are kept separately from your account, for no more than 2 years after the data they came from is deleted. Section 10's deletion schedule doesn't apply to them.
- Models stay ours. Models trained this way are part of SwathMap. We don't sell or license your Customer Data, its training copies, or training sets made from them, to anyone.
- Turning it off. You can turn training off at any time in your account settings. That stops any further use of your data for training, and we delete its training copies within 30 days. It doesn't remove what a model has already learned.
5.4 Statistics.
- We may compile and publish statistics that don't identify you, your growers or any field, such as total acres mapped or average processing time.
- We never sell or license Customer Data, field-level information or aggregated datasets to anyone.
5.5 What we never do with your data:
- (a) sell it;
- (b) use it to identify, contact or market to your growers or customers;
- (c) share it with any other company, our affiliates included, for that company's own purposes;
- (d) use your imagery to identify people.
The Data-Use Statement is part of these terms.
5.6 Data Processing Addendum.
- The DPA is part of these terms for every customer.
- It treats all Customer Data as your confidential data, whether or not any of it is personal information.
- If the DPA and these terms conflict about Customer Data, the DPA wins.
5.7 Feedback. You may send us ideas or feedback. We may use them without obligation to you.
6. What you are responsible for when you fly and upload
6.1 Compliance with the law. You are responsible for every flight whose data you upload, and for complying with all laws that apply to those flights and to the data you collect. That includes:
- FAA rules (Part 107, and for spraying Part 137 and any exemption you rely on) and airspace authorizations;
- state and local laws on drones, privacy and trespass, including any permission or consent those laws require;
- pesticide laws and product labels.
6.2 People and homes.
- Fly to map the land you are working on.
- Don't use the Service to watch, track or identify people.
- Avoid capturing people, homes and vehicles where you reasonably can.
- Don't upload images taken in breach of anyone's reasonable expectation of privacy.
6.3 Rights in what you upload. You must have the right to upload everything you upload, and to let us process it as these terms describe.
6.4 Your growers.
- You are responsible for telling your growers that you use service providers such as SwathMap to process their field data.
- You are responsible for handling their requests, for example to delete a map of their field.
- If a grower contacts us directly, we will pass the request to you and tell the grower we have done so.
7. Acceptable use
You may not:
- (a) use the Service for surveillance of individuals, or to locate, track or identify people (including by facial recognition);
- (b) upload content that is unlawful, infringing or harmful, or malware;
- (c) reverse engineer the Service, or access it other than through our apps and documented API;
- (d) get around rate limits, quotas or security measures, or load-test the Service without our written agreement;
- (e) share logins, or give people outside your business direct access to your account except through the Service's sharing features;
- (f) resell the Service except under a signed dealer or partner agreement;
- (g) use the Service, or non-public information about it, to build, train or improve a competing product, or give a competitor access for that purpose. A competitor is a business whose products compete with SwathMap's mapping features, or anyone acting for one. Customers who make, sell or service drones, and our dealers and partners, are not competitors for this purpose because of that activity alone. This doesn't limit honest reviews or public comment about the Service.
Processing imagery you capture for your own customers, and delivering the Outputs to them, is permitted use. We may remove content or suspend access that breaks this section (section 15).
8. Maps are planning aids
8.1 What Outputs are, and aren't.
- Maps, boundaries, obstacle and no-spray layers, elevation data, measurements, acreage, prescriptions and exports are planning aids.
- They are not survey-grade, not a legal property boundary, and not a navigation or obstacle-avoidance system.
- Accuracy depends on your flight, your GNSS/RTK and conditions on the day. Processing can fail, or distort a map, in ways that aren't obvious.
8.2 Check before you act.
- Before you fly a mission or spray from an Output, check the boundary, no-spray areas, buffers and obstacles against the field and the product label.
- Confirm the file loaded correctly on your drone or controller.
- You make every application decision. You remain responsible for following the label and the law; for drift, setbacks and buffers; and for the safety of your flights.
8.3 Exports and detected features.
- Exports are provided in the formats named in the Service. We don't guarantee that a file will load, or load correctly, on any particular drone, controller, app or version.
- Features we detect or suggest may be wrong or incomplete. That includes outlines from the outline tool and detected obstacles, weeds or crop rows.
8.4 What we're not responsible for. We are not responsible for loss that results from relying on an Output, including crop injury; drift or off-target application; label violations or regulatory penalties; and damage to aircraft or property. Section 17 also applies.
9. Processing and limits
9.1 Your processing slots. Each processing slot on your Plan lets one of your maps process at a time. More of your maps may run at once when there is spare capacity, but that isn't guaranteed.
9.2 No guaranteed turnaround. Maps may queue, take longer than usual or fail, for example during busy periods or maintenance. We don't promise a processing time.
9.3 Storage. When your storage is full, new uploads wait until you delete maps or add storage. We don't delete your maps because your storage is full.
9.4 Large datasets. Very large uploads may take much longer, may use all of your processing slots, may be processed at reduced quality, or may be declined or fail. The upload limits in force are shown in the Service.
10. Storage, retention and deletion
10.1 Photos.
- We delete the photos you upload 72 hours after the map made from them is finished. (Training copies under section 5.3 follow that section.)
- If a map fails, is held for review or is cancelled before it finishes, we keep its photos so the map can be retried. We may delete them 30 days after the map's last processing attempt.
- The original photos can't be downloaded after they are deleted. Your maps and drawings can.
10.2 One copy.
- We store your Outputs with a cloud storage provider, but we do not keep a second, independent backup copy.
- If they are lost or damaged, through a mistake, an attack or a provider failure, we may not be able to restore them.
- Download anything you can't afford to lose. Exports are free and available whenever your account is open.
10.3 Deleting a map.
- You can delete a map in the Service where it offers that, or ask us to.
- We then delete its photos, map files, drawings and outline-tool sessions from our storage.
- We keep a short record that the map existed, for billing, security and audit: its ID, your account ID, the name you gave it, dates, sizes and status.
10.4 When your subscription ends.
- Your maps stay viewable and downloadable for 30 days after your subscription ends.
- We email you when it ends, and again before deletion.
- After that we delete your Customer Data as in 10.3.
- To keep maps longer without paying for processing, choose a pause plan (4.7) before your subscription ends, where we offer one.
10.5 Outline-tool sessions are kept until their map is deleted, and for at most 2 years.
10.6 Copies outside our main storage. Customer Data is hosted and read from our main cloud storage. If we make a temporary copy to solve a support case, we delete it when the case closes.
10.7 Backups. Our database holds account and map records, not photos or maps. Its backups are overwritten within 7 days. Our providers' own systems may keep deleted data for a limited time under their published policies.
10.8 Legal holds. We may keep data longer where the law or a legal process requires it, and only for that purpose.
10.9 Training copies made under section 5.3 follow that section's schedule, not this section's.
11. Sharing maps
11.1 If you share a map through the Service, for example with a grower link, anyone who has the link or access can view it, and do what that share allows, until you revoke it or it expires.
11.2 You decide who to share with and are responsible for it. Anyone you share with may see whatever the shared map shows.
12. Security
12.1 We use reasonable administrative, technical and physical safeguards. They are summarized in the DPA's security annex.
12.2 We will notify you within 72 hours after we confirm a security incident that affects your Customer Data, or sooner where the law requires.
13. Confidentiality
13.1 Each of us will protect the other's confidential information with reasonable care, and use it only for this agreement.
13.2 Your Customer Data is your confidential information.
13.3 Our non-public information is ours, for example unpublished pricing, roadmaps and API documentation.
13.4 Neither of us has to keep confidential what was already public, already known, independently developed, or lawfully received from someone else. Either of us may disclose what the law requires, after notice to the other where the law allows.
14. Third-party services
14.1 Google Maps. The Service uses Google Maps features and content. Your use of them is subject to the Google Maps End User Additional Terms of Service (https://maps.google.com/help/terms_maps/) and the Google Privacy Policy (https://policies.google.com/privacy).
14.2 Payments. Payments are processed by Stripe. Card details go to Stripe; we don't receive full card numbers.
14.3 Partner Apps, drones and exports. When you ask us to send Outputs to a Partner App, a drone or controller, or another service, we send them because you asked. That service's terms govern what it does with them, and we are not responsible for it.
14.4 Open-source components. The Service includes open-source software, used under its own license terms (see the EULA).
15. Suspension and termination
15.1 Suspension. We may suspend access, with notice where practical, for non-payment, a security risk, or a breach of section 7.
15.2 Termination.
- Either of us may end this agreement for a material breach not fixed within 15 days of notice.
- You may cancel at any time; cancellation takes effect at the end of your paid term.
- If we end this agreement because of your breach, you can still export your maps for 30 days after our termination notice, unless the law prevents it.
- If you ask for an export before your maps are due for deletion, we hold the deletion until the export is delivered.
15.3 Survival. These sections survive termination: fees owed (4); 5.1 to 5.7; 8; 10; 12; 13; 16 to 18; 19.3; 21 to 24.
16. Warranties and disclaimers
16.1 We will provide the Service with reasonable skill and care.
16.2 APART FROM SECTIONS 2.1 AND 16.1, THE SERVICE AND OUTPUTS ARE PROVIDED "AS IS." TO THE EXTENT THE LAW ALLOWS, WE DISCLAIM ALL OTHER WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, UNINTERRUPTED OR ERROR-FREE OPERATION, AND COMPATIBILITY WITH ANY DRONE, CONTROLLER OR APP.
17. Limitation of liability
17.1 What neither of us is liable for. TO THE EXTENT THE LAW ALLOWS, NEITHER OF US IS LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES; LOST PROFITS OR REVENUE; LOST OR DAMAGED CROPS OR YIELD; DRIFT OR OFF-TARGET APPLICATION; FINES OR PENALTIES; OR LOSS OF DATA BEYOND OUR DUTIES IN SECTION 10.
17.2 Our cap. OUR TOTAL LIABILITY UNDER THIS AGREEMENT IS LIMITED TO THE FEES YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
17.3 Exceptions. The limits don't apply to your payment obligations or your obligations under section 18.
18. Indemnities
18.1 Yours. You will defend and indemnify us against third-party claims arising from:
- your flights;
- your Customer Data, including claims by growers, landowners or people in your imagery;
- your application decisions;
- your breach of law or of these terms.
18.2 Ours. We will defend and indemnify you against third-party claims that the Service itself (not your data) infringes a U.S. patent, copyright or trademark.
18.3 Procedure.
- Notice: the party claiming indemnity notifies the other promptly.
- Defense: it lets the other control the defense, and cooperates at the indemnifying party's cost.
- Settlement: a settlement that admits fault or imposes obligations on the protected party needs that party's consent.
19. Changes
19.1 To the Service. Section 2.5 applies.
19.2 To these terms.
- We will give at least 30 days' notice by email of material changes to these terms, the DPA, the Data-Use Statement or the EULA, with a summary of what changed and the date it takes effect.
- If you don't accept a material change, you may cancel before it takes effect, with a refund under section 4.5.
- Changes don't apply to disputes that arose before they took effect.
19.3 We will not use Customer Data you have already given us in a broader way than these terms allow without your consent. For example, we won't start sharing it, or training on it after you've turned training off. Such a change won't happen through an update to these terms or our privacy policy alone.
20. Sale of the company, and assignment
20.1 If AFL or SwathMap is sold, merged or reorganized:
- these terms and the DPA bind the new owner;
- we will tell you within 30 days;
- you may then close your account and export your data.
20.2 Either of us may assign this agreement to a successor in a merger or sale of the business it relates to, with notice to the other. Any other assignment needs the other's consent.
21. Governing law and disputes
21.1 Law. The law of the State of Illinois governs these terms, without regard to its conflict-of-law rules.
21.2 Talk first. Before starting an arbitration, the party with a dispute will send the other a written notice describing it, and we will both try in good faith to resolve it for 30 days.
21.3 Arbitration.
- Disputes not resolved that way go to binding arbitration under the American Arbitration Association's Commercial Arbitration Rules, seated in Polo, Illinois.
- Hearings may be held by video.
- The Federal Arbitration Act governs this section.
21.4 Exceptions.
- Either party may bring an individual claim in small-claims court.
- Either party may seek an injunction in court to protect confidential information or intellectual property.
- Any claim heard in court goes to the state or federal courts with jurisdiction over Ogle County, Illinois.
21.5 Individual claims only. Each party brings claims only individually, not in a class, consolidated or representative proceeding. If this section 21.5 is found unenforceable for a claim, that claim goes to court under 21.4 instead of arbitration.
22. Electronic communications and notices
22.1 You agree to receive agreements, notices and other communications from us electronically, by email or in the Service, and that they satisfy any requirement to be in writing. Your electronic acceptance of these terms has the same effect as a signature.
22.2 Notices to you go to the email address on your account. Keep it current.
22.3 Notices to us go to support@agriflightlogs.com.
23. Copyright complaints
23.1 Notices. If you believe material in the Service infringes your copyright, send our designated agent a notice that includes: your physical or electronic signature; the work you say is infringed; the material you say infringes, with enough detail to find it; your contact details; a statement that you believe in good faith the use isn't authorized; and a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner.
23.2 Counter-notices. If material you posted was removed and you believe that was a mistake or a misidentification, you may send a counter-notice that includes: your physical or electronic signature; the material removed and where it was before removal; a statement, under penalty of perjury, that you believe in good faith it was removed by mistake or misidentification; your name, address and telephone number; your consent to the jurisdiction of the federal district court for your address (or, outside the United States, any district where we may be found); and your agreement to accept service of process from the person who sent the original notice.
23.3 Repeat infringers. We may remove material and, in appropriate cases, close the accounts of repeat infringers.
23.4 Designated agent: Copyright Agent, Agri Flight Logs LLC, support@agriflightlogs.com.
24. General
24.1 Entire agreement and order of precedence. These terms, the DPA, the Data-Use Statement, the EULA and any order form are the whole agreement. If they conflict, they apply in this order:
- the order form;
- the DPA, for Customer Data;
- the Data-Use Statement;
- these terms;
- the EULA.
24.2 Force majeure. Neither of us is liable for delays caused by events beyond reasonable control, such as natural disasters, outages of third-party networks or providers, or acts of government.
24.3 Export and sanctions. You will comply with U.S. export and sanctions laws.
24.4 Boilerplate.
- Independence: we are independent contractors, and these terms create no rights for anyone else except as the EULA says for app stores.
- Severability: if a provision is unenforceable, the rest stands.
- Waiver: not enforcing a provision is not a waiver.
25. Contact
