SwathMap End-User License Agreement

Effective Date: October 15, 2026

This End-User License Agreement ("EULA") is between you and Agri Flight Logs LLC ("AFL", "we", "us") and covers the SwathMap software: the SwathMap web app (including any version you install on a phone, tablet or computer), any SwathMap mobile app, and the SwathMap API (together, the "Software"). It forms part of the SwathMap Terms of Service (the "Terms"), and words defined in the Terms mean the same here. If this EULA and the Terms conflict, the Terms win.

1. License

While your account is in good standing, we give you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use the Software for your business, including to process imagery you capture for your own customers and to deliver the Outputs to them.

2. Restrictions

You may not:

(a) copy, modify, translate or make derivative works of the Software;
(b) reverse engineer, decompile or disassemble it, except where the law allows despite this restriction;
(c) sell, rent, lease, sublicense or distribute the Software, or offer it as a service to others, except under a signed dealer or partner agreement;
(d) remove or alter any proprietary notice;
(e) access the Software by automated means except through the documented API and your own API keys;
(f) use the Software in breach of the acceptable-use rules in section 7 of the Terms.

3. Ownership

We and our licensors own the Software and all rights in it. This EULA gives you no rights in our names or trademarks. Your Customer Data and Outputs are yours (section 5 of the Terms).

4. Updates

We may update the Software, including automatically, and an update may be required to keep using it. This EULA covers updates unless an update comes with its own license. If a new feature has additional terms or fees, we will show them to you before you first use or buy it (section 2.5 of the Terms).

5. Open-source components

The Software includes open-source components that are licensed under their own terms. Those terms govern your use of those components to the extent they conflict with this EULA.

6. Ending this license

This license ends when your access to SwathMap ends under the Terms, or automatically if you break this EULA. When it ends, stop using the Software. Your right to export your data is in sections 10 and 15 of the Terms.

7. Disclaimers and liability

The Software is covered by the warranties, disclaimers and limitations of liability in sections 16 and 17 of the Terms. OUTSIDE THOSE SECTIONS, THE SOFTWARE IS PROVIDED "AS IS", AND THOSE SECTIONS' LIMITS APPLY TO ANY CLAIM ABOUT THE SOFTWARE.

8. App stores

If you get a SwathMap app from an app store such as the Apple App Store or Google Play:

(a) this EULA is between you and AFL, not the app store provider, and AFL alone is responsible for the app, its maintenance and support, and any claims about it, including product-liability, legal-compliance and intellectual-property claims;
(b) your license is to use the app on devices you own or control, as the app store's usage rules allow;
(c) if the app fails to meet a warranty that applies by law, you may tell the app store provider, which may refund the price you paid for the app under its rules; the app store provider has no other warranty obligation;
(d) you confirm that you are not in a country under a U.S. embargo or designated as supporting terrorism, and are not on a U.S. government list of prohibited or restricted parties;
(e) you will follow any third-party terms that apply when you use the app, such as your mobile data plan;
(f) the app store provider and its subsidiaries are third-party beneficiaries of this EULA and may enforce it against you.

9. Law and disputes

Section 21 of the Terms (Illinois law; arbitration in Polo, Illinois) applies to this EULA.
